Terms of NavPix Library Service Use
			


			By using the NavPix Library, a service of Navman Europe Ltd ("Navman" or “we” or similar pronouns), you agree to be bound by the following terms and conditions (the “Terms of NavPix Library Service Use”).  The Terms of NavPix Library Service Use are supplementary to Navman’s website Terms 
			and Conditions and Privacy Policy and, if there is a conflict between the Terms of NavPix Library Service Use on the one hand and the Terms and Conditions and/or Privacy Policy on the other hand, the Terms of NavPix Library Service Use will prevail as to the use of the NavPix Library Service.
			


			Basic Terms
			
    
				
  1. You are responsible for all activities that occur under your screen name.  You are responsible for keeping your password secure and the misappropriation of your password other than by a negligent or wilful act or omission of Navman will be no excuse for any violation of these terms.

  2. You must not post any materials to the NavPix Library or to any other portion of any Navman website that are obscene or that are illegal in any jurisdiction in which such materials might be viewed by other users.

  3. You must not abuse, harass, threaten, impersonate or intimidate other NavPix Library users.


    4. 
				
  4. You may not use the NavPix Library service for any illegal or unauthorised purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.

  5. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and/or video clips, links, an other information or materials that you submit, post, and/or display on the NavPix Library service (“Content”).

  6. The NavPix Library is intended for personal use and is not a general image hosting service. Professional or business uses of the NavPix Library are prohibited.


    7. 
				
  7. You must not modify, adapt or hack the NavPix Library or modify another website so as to falsely imply that it is associated with the online NavPix Library.


    8. 
				
  8. You must not create or submit any unsolicited commercial e-mail (“Spam”) to any NavPix Library member.


    9. 
				
  9. You must not transmit any worms, viruses, or any other code or materials of a destructive nature.


    10. 
				
  10. You must not, in the use of the NavPix Library, violate any laws in your jurisdiction (including but not limited to copyright laws) or in any jurisdiction in which Navman operates (as such jurisdictions are identified in the Terms of Use and/or Privacy Policy.

  11. By submitting any Content to the NavPix Library, you represent and warrant to Navman and to Navman’s service providers and persons with whom Navman contracts or shares the Content that you have all rights necessary to submit such Content to Navman and to grant to Navman 
				all rights necessary to allow Navman to perform the services associated with the NavPix Library and to copy, reproduce, prepare derivative 
				works of, display, perform, and electronically transmit all Content as Navman sees fit.  You further represent and warrant to Navman that you have secured the permission of all 
				persons depicted in the Content for their likenesses to be displayed in the NavPix Library, including displays that do, or tend to, endorse or promote Navman and/or its products and/or services.  You must indemnify, defend, and hold harmless Navman and its equityholders, managers, 
				directors, officers, employees, and agents from and against any claim, suit, or action (and any losses, damages, costs, and fees, including reasonable attorneys’ fees) alleging that Navman’s possession, use, display, performance, copying, reproduction, or other use of the Content 
				as contemplated hereby infringes upon, violates, or misappropriates any copyright, moral right, right of privacy, patent, trademark, trade secret, or any other intellectual property, privacy, contract, or other right of a third party.

			Navman reserves the right to enforce these terms, whether as part of a monitoring process or otherwise, but Navman undertakes no obligation to do so.  It is possible and even likely that you might be presented with, or view, materials that you find objectionable or offensive.  You assume 
			such risk when you view materials in the NavPix Library and Navman undertakes no obligation to monitor, moderate, screen, or otherwise control such materials, regardless of whether such materials violate these terms.

			General Conditions
			
    
				
  1. We reserve the right to modify or terminate the NavPix Library service for any reason, without notice at any time.


    2. 
				
  2. We reserve the right to alter these Terms of NavPix Library Service Use at any time. If the alterations constitute a material change to the Terms of NavPix Library Service Use, we will notify you according to the communication preference expressed on your account. 


    3. 
				
  3. We reserve the right to refuse service to anyone for any reason at any time.


    4. 
				
  4. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of NavPix Library Service Use.

  5. Your account will also be terminated if it is used for hosting graphical elements (including but not limited to icons, photographic elements, avatars and smilies) on external websites.

			NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT
			


			Navman respects the intellectual property of others, and we ask the same of our NavPix users and community. Navman may, in appropriate circumstances and at its discretion, disable and/or terminate the NavPix Library accounts of users whom Navman believes infringe the 
			copyright and/or intellectual property and/or other rights of others.
			


			If you believe that the copyright of your work has been infringed or that your intellectual property or other rights have been violated in any other way, you should contact Navman’s Copyright Agent, providing the following information:
			
    
				
  1. An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright or other intellectual property interest;


    2. 
				
  2. A description of the copyrighted work or other intellectual property that you claim has been infringed;


    3. 
				
  3. A description of where the material that you claim is infringing is located on the site or in the library;


    4. 
				
  4. Your address, telephone number, and email address;


    5. 
				
  5. A statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or applicable law;

  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorised to act on the copyright or intellectual property owner's behalf.
